Michael L. Caldwell leads the firm's successful environmental law practice and is one
of a select group of environmental law attorneys with extensive litigation experience.
Mr. Caldwell has successfully resolved environmental and land use issues for Fortune
50 companies and municipalities as well as individuals and small businesses. He is
known for his hands-on, personal approach and for seeking out creative and cost-effective
solutions to his clients' legal and business issues.
Mr. Caldwell represents clients on a wide range of environmental matters involving
litigation, soil and groundwater remediation, brownfield redevelopment, land use,
real estate transactions, and wetlands permitting issues. Mr. Caldwell concentrates his
litigation practice - which currently includes defending one of the highest profile
environmental enforcement actions in the State of Michigan - on Superfund cost recovery,
toxic tort class actions, mold, and insurance coverage claims, as well as on general civil
litigation and insurance coverage matters. Mr. Caldwell has helped developers and
municipalities site electrical power generating plants, bulk petroleum distribution
facilities, and residential developments on environmentally challenged properties.
He has successfully negotiated prospective purchaser agreements and covenants-not-to-sue
with both federal and state agencies in connection with such brownfield projects.
He also regularly counsels clients on complex real estate and business transactions
involving Superfund and other contaminated sites.
As a member of the Part 201 Advisory Group, Mr. Caldwell has actively participated in
drafting the guidance materials and administrative rules needed to implement state
environmental laws. He lends his environmental law expertise as a frequent author and
speaker. Recent clients include Atlas Oil, the City of Wyandotte, Creative Solutions
Group, MSI Corporation, Pall Corporation, Ramco-Gershenson, and Waste Management.
